Tata Cara Jual-Beli Tanah

Jual beli tanah merupakan hal yang sering terjadi dalam kehidupan sehari-hari di masyarakat. Apabila antara penjual dan pembeli sudah bersepakat untuk melakukan jual beli tanah terhadap tanah yang sudah bersertifikat maka beberapa langkah yang harus ditempuh adalah :

1. Akta Jual Beli (AJB)
Si penjual dan si pembeli harus datang ke Kantor Pejabat Pembuat Akta Tanah (PPAT) untuk membuat akta jual beli tanah. PPAT adalah Pejabat umum yang diangkat oleh Kepala Badan Pertanahan Nasional yang mempunyai kewenangan membuat akta jual beli dimaksud. Sedangkan untuk daerah-daerah yang belum cukup jumlah PPAT-nya, Camat karena jabatannya dapat melaksanakan tugas PPAT membuat akta jual beli tanah.

2. Persyaratan AJB
yang diperlukan untuk membuat Akta Jual Beli Tanah di Kantor Pembuat Akta Tanah adalah :
a. Penjual membawa :
· Asli Sertifikat hak atas tanah yang akan dijual.
· Kartu Tanda Penduduk.
· Bukti pembayaran Pajak Bumi dan Bangunan.
· Surat Persetujuan Suami/Isteri bagi yang sudah berkeluarga.
· Kartu Keluarga.

b. Sedangkan calon pembeli membawa :
· Kartu Tanda Penduduk.
· Kartu Keluarga.

3. Proses pembuatan akta jual beli di Kantot PPAT.

a. Persiapan Pembuatan Akta Jual Beli.
1) Sebelum membuat akta Jual Beli Pejabat pembuat Akta Tanah melakukan pemeriksaan mengenai keaslian sertifikat ke kantor Pertanahan.
2) Pejual harus membayar Pajak Penghasilan (PPh) apabila harga jual tanah di atas enam puluh juta rupiah di Bank atau Kantor Pos.
3) Calon pembeli dapat membuat pernyataan bahwa dengan membeli tanah tersebut ia tidak menjadi pemegang hak atas tanah yang melebihi ketentuan batas luas maksimum.
4) Surat pernyataan dari penjual bahwa tanah yang dimiliki tidak dalam sengketa.
5) PPAT menolak pembuatan Akta jual Beli apabila tanah yang akan dijual sedang dalam sengketa.

b. Pembuatan Akta Jual Beli
1) Pembuatan akta harus dihadiri oleh penjual dan calon pembeli atau orang yang diberi kuasa dengan surat kuasa tertulis.
2) Pembuatan akta harus dihadiri oleh sekurang-kurangnya dua orang saksi.
3) Pejabat pembuat Akta Tanah membacakan akta dan menjelaskan mengenai isi dan maksud pembuatan akta.
4) Bila isi akta telah disetujui oleh penjual dan calon pembeli maka akta ditandatangani oleh penjual, calon pembeli, saksi-saksi dan Pejabat Pembuat Akte Tanah.
5) Akta dibuat dua lembar asli, satu lembar disimpan di Kantor PPAT dan satu lembar lainnya disampaikan ke Kantor Pertanahan untuk keperluan pendaftaran (balik nama).
6) Kepada penjual dan pembeli masing-masing diberikan salinannya.

4. Bagaimana langkah selanjutnya setelah selesai pembuatan Akta Jual Beli ?
a. Setelah selesai pembuatan Akta Jual Beli, PPAT kemudian menyerahkan berkas Akta Jual Beli ke Kantor Pertanahan untuk keperluan balik nama sertifikat.
b. Penyerahan harus dilaksanakan selambat-lambatnya tujuh hari kerja sejak ditandatanganinya akta tersebut.

5. Berkas yang diserahkan itu apa saja ?
a. Surat permohonan balik nama yang ditandatangani oleh pembeli.
b. Akta jual beli PPAT.
c. Sertifikat hak atas tanah.
d. Kartu Tanda Penduduk (KTP) pembeli dan penjual.
e. Bukti pelunasan pembayaraan Pajak Penghasilan (PPh).
f. Bukti pelunasan pembayaran Bea Perolehan Hak Atas Tanah dan Bangunan.

6. Bagaimana prosesnya di Kantor Pertanahan ?
a. Setelah berkas disampaikan ke Kantor Pertanahan, Kantor Pertanahan memberikan tanda bukti penerimaan permohonan balik nama kepada PPAT, selanjutnya oleh PPAT tanda bukti penerimaan ini diserahkan kepada Pembeli.
b. Nama pemegang hak lama (penjual) di dalam buku tanah dan sertifikat dicoret dengan tinta hitam dan diparaf oleh Kepala Kantor Pertanahan atau Pejabat yang ditunjuk.
c. Nama pemegang hak yang baru (pembeli) ditulis pada halaman dan kolom yang ada pada buku tanah dan sertifikat dengan bibubuhi tanggal pencatatan dan ditandatangani oleh Kepala Kantor Pertanahan atau pejabat yang ditunjuk.
d. Dalam waktu 14 (empat belas hari) pembeli sudah dapat mengambil sertifikat yang sudah atas nama pembeli di kantor pertanahan.

Bank urges 'new deal' on hunger

The World Bank has called on the international community to co-ordinate its efforts in a "new deal" to fight global hunger and malnutrition.

A move was needed because of soaring global food and energy prices, said the bank's president, Robert Zoellick.

Mr Zoellick said the top priority was to give the UN World Food Programme an extra $500m for emergency food aid.

The World Bank estimates 33 countries face potential social unrest because of rising food and energy prices.

As well as urging the US, the EU, Japan and other developed countries to provide the World Food Programme with extra funds for emergency aid, Mr Zoellick said the new deal required a shift towards a broader concept of food and nutrition assistance.

'Green revolution'

Funds to help build local food markets and boost agricultural productivity could create a "green revolution" for sub-Saharan Africa, he said.

Mr Zoellick also outlined a plan to encourage sovereign wealth funds from emerging economies like China, India and Brazil to invest in Africa, in what he called a "one percent solution".

"Today, sovereign wealth funds hold an estimated $3 trillion in assets," he said.

"If the World Bank Group can help create the platforms and benchmarks, the investment of even 1% of their assets would draw $30bn to African growth, development and opportunity."

Mr Zoellick said trade was also key to lowering food prices, and that a fairer and more open trade system would encourage farmers in developing countries to expand production.

He criticised what he described as "protectionism" and "isolationism" including by his own country, the US.

"The poor need lower food prices now. But the world's agricultural trading system is stuck in the past," he said.

"If ever there was a time to cut distorting agricultural subsidies and open markets for food imports it must be now."

OPEC NEWS

The head of Opec, the cartel of oil-producing nations, has said it is unlikely to increase production at this week's meeting.

It had been hoped members would boost the supply of oil to help prices fall from their historically-high levels.

Crude oil hit a new record of almost $104 a barrel at the start of the week but settled at $99.52 late on Tuesday.

Oil ministers from Opec member nations are gathering in Vienna ahead of their meeting which starts on Wednesday.

"I don't think Opec would consider increasing production because then we would be increasing to meet a demand that doesn't exist," Opec President Chakib Khelil said.

US government data, due on Wednesday, is expected to show it has a good supply of crude oil and domestic fuel.

US President George W Bush said it would be an error if Opec members didn't recognise the impact high prices were having on the US.

"I think it is a mistake to have your biggest customer's economy to slow down....as a result of high energy prices," he said.

Earlier the International Energy Agency had said it favoured output to remain at current levels, even as supplies were tight.

Oil prices have risen to record highs due to high demand for the commodity and the weakening dollar, which has prompted investors to switch to oil and other reputed safe havens such as gold.


Oil price up $2 as economy slows

Oil prices climbed more than $2, tipping beyond $106 a barrel, after weaker-than-expected job data indicated further signs of a slowing economy.


Crude oil futures for May rose $2.4 a barrel to settle at $106.23 in New York. Meanwhile London Brent crude, finished $2.38 higher at $104.9.

Commodities are viewed as an attractive alternative investment to dollars.

Reports of a fire at an Exxon Mobil US refinery also contributed to the rise, prompting fears over petrol supplies.

The summer is typically a time of high petrol consumption in the US, as people take holidays, so any signs that supplies will be disrupted can help push up prices.

The dollar weakened in relation to the euro after a official data showed employers cut 80,000 jobs in March - the biggest monthly job decline in five years.

"Crude futures were higher as the dollar weakened," said Nimit Khamar, an analyst with Sucden in London.

When the dollar weakens it becomes cheaper for foreign buyers to invest in commodities.

Kansas Dismantles North Carolina

Roy Williams taught Kansas all about how to handle cruel, crushing disappointments.

Bill Self schooled the Jayhawks on how to dish out some pain of their own.

Kansas left its former coach in the dust Saturday night, getting 25 points and seven rebounds from Brandon Rush to stave off a ferocious comeback by North Carolina for an 84-66 victory in the national semifinals.

Trailing 40-12 late in the first half, Tyler Hansbrough, Wayne Ellington and the Tar Heels made a valiant rally, getting to within five points with nine minutes left.

But they fell short in their effort to pull off the biggest Final Four comeback ever.

"We sort of came out a little more casual than we would've liked and they hit us right between the eyes," Williams said.

Now, the Jayhawks will play Memphis, an earlier 78-63 winner over UCLA, in Monday's title game.

Kansas moved within a win of its first national championship since 1988, the year before Williams began his storied 15-year tenure in Lawrence - one that ended when he jilted Kansas for his alma mater.

"I hope it's set aside and goes away forever," Williams said of the animosity that has lingered since he left in 2003. "I'm too thin-skinned, probably. ... Let's don't focus on that. Focus on the great job done by Kansas."

Hansbrough had 17 points and nine rebounds for North Carolina (36-3) - a typically gutsy effort - but his next move will be to decide whether to come back for his senior season.

Kansas has more pressing things to deal with - stopping fast-breaking Memphis and its sensational freshman Derrick Rose.

"We know we've got another step to take Monday night," Sherron Collins said. "It's going to be a great matchup. They play fast, we play fast."

Collins had two assists, a 3-pointer and a pair of free throws during the decisive stretch that saw the Jayhawks (36-3) pad that five-point lead back to 15 and send the Tar Heels into true desperation mode.

Williams stood stoically as the clock ticked down, arms folded, nothing much left to do. Tears usually come pretty quickly after the final buzzer of the season for him, and this season ended one game short of where many thought it might.

"We've had a good year, but I don't think anybody's goal here was to be one of the top four teams in the country," Hansbrough said. "It's to be the top team. I'm frustrated with that."

Williams got outcoached in this one, especially at the beginning, finding no solution for Kansas' strategy of dumping the ball inside to Darrell Arthur, Darnell Jackson and Cole Aldrich.

The Jayhawks also smothered Hansbrough, even flooring him once on a hard foul by Mario Chalmers.

"To start the game, I felt, instead of having 10 hands out there it felt like we had 14 or 16," said Self, in his first Final Four since replacing Williams five years ago. "Guys were making a move, a reverse pivot, and there were two hands there waiting for them."

Despite North Carolina's impressive comeback, the final stats painted a picture of Kansas domination. The Jayhawks shot 53 percent from the floor and held the nation's second-leading offense to 35 percent. They had nine more rebounds, 10 more assists, six more blocks.

This marked the first chance to see Self and Williams go against each other with their new teams - and on the game's biggest stage.

Self coached Kansas to the lead. Williams coaxed his team back in it.

But for all North Carolina's effort, this game was lost early.

"I've never been so embarrassed in my life," Tar Heel guard Marcus Ginyard said of the first 10 minutes.

The basket looked as big as the Alamo for the Jayhawks, who made 12 of their first 16 shots and went on an 18-0 run for a 33-10 lead with 9:31 left.

Meanwhile, the Tar Heels went a stunning 9:03 without a basket. No team has overcome a deficit bigger than 22 at the Final Four, and it was around the time the lead was 40-12 that none other than Billy Packer, the CBS (nyse: CBS - news - people ) analyst, said the game was over.

Not so fast.

Carolina turned this into controlled chaos over the first 10 minutes of the second half, altering Kansas shots and making pretty much everything they threw up - including a 3-pointer by Ellington (18 points) with 9:20 left that made it 58-53 and had the Tar Heel fans in a frenzy.

Throughout the rally, Self called time-out after time-out - KU fans often criticized Williams for not doing the same under similar circumstances - and eventually, North Carolina cooled and Kansas ran away.

Picking a Jayhawks star was as easy as closing your eyes and pointing to a name on the stat sheet.

Aldrich stood out, swatting three shots in the first half and altering more after coming off the bench en route to his eight-point, seven-rebound night. His highlight came after KU missed just its fifth shot of the game, more than 10 minutes into the first half, and he outgrappled Hansbrough for a rebound that resulted in two free throws. That made it 33-10.

Arthur had three buckets and an assist in the first five minutes to start the runaway. Russell Robinson had five points, four assists, three steals and three turnovers over the first 20 minutes - what coach wouldn't love that?

All that might have helped prove Williams' theory, as he tried to deflect all the talk of himself this week: That the game would be decided by the players.

The Jayhawks were simply better.

Die-hard KU fans might have deemed it their team's best moment since the 2003 Final Four, when Nick Collison helped dismantle Marquette 94-61 in the semifinals.

Two nights later, the Jayhawks lost to Syracuse in the finals. With talk swirling that Williams would be headed to Tobacco Road, he said on live TV that he "could give a (bleep) about North Carolina right now."

Two weeks later, he was wearing Carolina blue and Kansas fans were seeing red.

Maybe now, they'll be more willing to let bygones be bygones.

"I told my team that I hoped that distraction didn't bother them, because that would be about as bad as anything you could ever have as a coach," Williams said.
